John Holland is seeking an experienced Commercial Manager to join the Next Rail team, based in Mascot.
Responsibilities of the role include: Ensure project managers, contract administrators and all relevant project staff understand and comply with commercial requirements.
Attend contract acceptance and contract review meetings as necessary to ensure commercial and contract administration issues comply with contract requirements, policies and procedures.
Interpret the tender and apply the commercial and contractual agreement both at Head Contract and Sub Contract level as per the Security of Payments Act.
Manage commercial issues, major and minor contract disputes when delegated by senior management.
Assist contract administrators and project managers as needed in commercial matters.
Review and approve acceptance or proposed major / high risk subcontracts and any other subcontracts as instructed by senior management.
Lead identification and qualification of Head Contract scope changes and all subsequent negotiations with the client.
Negotiate contract terms and conditions with customer/ subcontractors as authorised by senior management in liaison with project management, as per policies, procedures and guidelines.
Undertake post-contract completion reviews, analyse results.
Undertake corrective actions.
Ensure successful stakeholder and people management.
Financial management.
Ensure strong contract, commercial and financial risk management.
You will: See yourself as an established Contracts Manager or Commercial Manager looking to further your career in a key leadership role within a top tier contractor on a major project.
Have a clear drive to achieve quality commercial outcomes and have demonstrated success in a similar role - we are interested in your skill base and potential, not the size of your past projects.
Provide commercial and contractual support on pre-contract and post-contract matters and issues to ensure successful financial outcomes are achieved by the project.
Support both the delivery and commercial teams by providing advice to about contractual issues and mentoring of team members on contractual issues and strategies.
Provide commercial guidance to the Rail business unit on contract and risk management, including costings and programming strategies.
Lead a passionate team of commercially minded professionals, whilst also growing the team's technical and leadership skills.
To be successful in this key role, you must have: Bachelor's Degree or equivalent in Law, Commerce, Accounting, Quantity Surveying, Business or other associated disciplines.
7 years' experience in commercial and contract administration gained on construction, engineering or associated projects.
2-5 Years' experience in commercial management role.
Post graduate qualifications e.g.
graduate certificate, graduate diploma in Commerce, Accounting, Quantity Surveying, Business, Construction, Property, Law or other associated disciplines is desirable.
Advanced skills in procedures for project contract administration, general business administration and project management.
Reporting and compliance with respect to commercial performance and legislation/ code to prevent potential business exposure.
Understand scope of works for the project and regions and business units and each subcontracted section of works including the ability to interpret drawings and specifications.
Skill in quantitative and qualitative risk assessment and development of risk controls and actions involved in delivery and implementation of projects.
