Job Description: We are seeking an enthusiastic and passionate Senior Commercial Law Associate to join our team at our Melbourne CBD Office (although a position at our Dandenong Office will also be considered).
As a Senior Commercial Law Associate, you will handle a wide range of commercial matters and have high proficiency in most of the following areas (not with some experience in these areas or merely interested in learning these areas): Business law, including the sale and purchase of businesses; Contract law, including drafting and advising on contracts and agreements (including franchising agreements), contractual breaches, negotiating contracts, and debt recovery; Corporate law, including the formation, governance, compliance and dissolution of corporations, mergers and acquisitions, corporate structures, directors' duties, shareholder rights, shareholder/unitholder agreements, and insolvency; Commercial litigation, including disputes in commercial transactions, franchising disputes, breach of contract, debt recovery, shareholder disputes and professional negligence; Civil litigation, including debt recovery enforcement, warrants, statutory demands and bankruptcy proceedings; Real estate law, including drafting and advising on agreements for the purchase, sale and leasing of real property, as well as real estate transactions and negotiating property-related disputes; Commercial leasing, including negotiating and drafting commercial lease agreements for business premises; Intellectual property law, including patents, trademarks and copyrights, as well as licensing and infringement issues and intellectual property rights and disputes (desirable but not required); Arbitration and alternative dispute resolution; and PPSR (Personal Property Securities Register) lodgment and removal.
Your expertise and in-depth knowledge of commercial law will be vital in providing strategic legal advice, representing clients in court proceedings, and negotiating settlements.
Responsibilities: Manage a diverse caseload of commercial law matters, from initial consultation to resolution.
Provide expert legal advice and guidance to clients, ensuring their rights and interests are protected.
Represent clients in court hearings, mediations and negotiations, including by doing all their own court hearings.
Draft and review legal documents, including pleadings, motions, and settlement agreements.
Stay updated on changes in commercial law statutes, regulations, and precedents.
Conduct thorough legal research and analysis to develop effective case strategies.
Build and maintain strong client relationships through clear communication, practical and pragmatic advice, and empathetic guidance.
Qualifications & Requirements: Juris Doctor (J.
D.) or Bachelor of Laws (LLB) degree from an accredited law school.
Completion of supervised legal practice period.
Admission to practice in both the Supreme Court of Victoria and the High Court of Australia.
8+ years of experience in commercial law litigation.
Be able to manage all aspects of commercial law cases from initial consultation to resolution.
Skills: Ability to handle both drafting and litigation.
Proven track record of successfully handling commercial law cases from start to finish.
Ability to handle commercial law cases without supervision.
Be self-reliant and independent.
Be able to lead a commercial law department and manage a team of lawyers and legal assistants.
Strong negotiation, advocacy and interpersonal abilities.
Excellent oral and written communication skills.
Excellent organisational skills and attention to detail.
Ability to work effectively under pressure and to meet deadlines.
Quick responses to clients' urgent matters and swift turnover.
Demonstrated commitment to maintaining high ethical standards.
Ability to provide pragmatic and sensible resolutions.
Empathy and sensitivity to the needs of clients.
Be confident when speaking with clients – this includes the ability to turn a prospect into a client/appointment.
Be currently billing equivalent of 3.5 times their current salary without a legal assistant/paralegal.
