About the role
Reporting to the Manager, Compliance and Investigations, the Senior Compliance Investigator combines the traditional roles of a regional inspector and an investigator and is responsible for carrying out a range of complex and routine compliance activities under the legislation administered by Consumer Affairs Victoria (CAV). This includes conducting inspections, monitoring compliance, and identifying breaches. The role involves gathering evidence by obtaining comprehensive written statements, affidavits, and other documentation for use in legal proceedings, and issuing infringement notices where appropriate.
The Senior Compliance Investigator will also conduct thorough investigations into significant breaches of consumer law, analyse findings, and develop recommendations for enforcement actions. This may involve preparing briefs of evidence, participating in Court and Tribunal actions, and contributing to the department's integrated compliance and enforcement strategy. Additionally, the role includes mentoring and providing guidance to less experienced team members to enhance their skills and knowledge in compliance and investigation processes.
The role is part of CAV's Underquoting Taskforce, which addresses the unfair and deceptive practice of underquoting that can mislead prospective buyers in the residential real estate market. The taskforce aims to understand the drivers and behaviours behind underquoting and to develop strategies that eliminate these practices, thereby boosting consumer confidence in CAV's regulation of the real estate industry.
About you
To be considered for the role, you must be able to:
Plan and conduct a range of compliance monitoring activities, inquiries, and investigations pursuant to the legislation administered by Consumer Affairs Victoria, and specifically the Underquoting Taskforce, including the preparation of reports and briefs of evidence. You will also be required to obtain comprehensive written statements and affidavits for use in legal proceedings.
Be appointed as an Inspector under the Australian Consumer Law and Fair Trading Act and be delegated as an Inspector under the Residential Tenancies Act.
Undertake advanced case management which may include cross-agency or CAV-wide collaboration.
Convey specialist concepts and provide information to traders, community groups, consumers, employees of CAV, and other parties as to the rights and obligations under the legislation administered by the office, including answering general enquiries from the public and constructively encouraging compliance.
